It has been 7 years since we began defending ourselves
against our beloved First Union/Wachovia/Wells Fargo.
7 years of our lives that have been spent with a devotion
to hold the bank accountable for their pathetic business practices.
Now, that doesn't count the 5 years prior
that we worked our butts off to build our businesses.
And that doesn't count the 5 years of lies
that we were told in order to "shut us up".
No wonder the banks can get away with destroying a whole country,
maybe even a whole world's economy.
Look how long they have managed to disrupt our world
just because we want them to be held accountable
for the mess they left behind.
Our lives, our children's lives, our future...
everything we worked hard for was nothing to
that BIG BANKING EXECUTIVE.
Thank you (INSERT BANKING EXECUTIVE NAME HERE).
I hope I get to meet you one day.
An appology would be nice, but who is playing nice anymore?
I hope your children got something out of what you took from mine.
I hope you and your wife slept well at night while we laid awake with worry.
I hope you retire at a wonderful age since we paid for it.
I hope you kept your income since we lost ours.
I hope you maintained an excellent credit score, to make up for destroying mine.
I hope you laughed about our loss with your friends
to balance out what we discussed with ours.
I hope you enjoy the life we have provided for you.
Enjoy your wealth at the expense of others,
and I can only hope you read this.
But most of all,

I just watched the news about The Bluff Community of Atlanta.
I am ashamed that one of our communities could be so heartlessly overlooked.
A neighborhood of families.
A father loses his job and his house is foreclosed on...
one less neighbor.
One more house boarded up, one less family in the Bluff community.
... Then it happens again and again and again.
Drugs, prostitution and crime move in.

It wasn't always like that, it was a neighborhood of families.

It may not be some where you would want to live but
it is where The Bluff's residents' wanted to live.
They are some the 99%er that are being hit hard.
What if it were your neighborhood?
Just for fun,

what if you couldn't stop the demise of your safe, warm neighborhood?
What if your neighbor lost his job, then his house?

I am positive that The Bluff residents fought back;
are still fighting back.

The remainder of families at The Bluff
can't leave or refuse to give up.
They are losing their battle.
Crime continues to run rampant in The Bluff community.
I did not see the name of a big corporation or large group
that had decided to stand up for The Bluff community.
The current elected government is having a hard time picking sides long enough to help or even see The Bluff.
So that leaves it up to the residents of The Bluff community.
Their numbers are small but they are their own 99%.
Who can hear their cries?
Like Horton Hears A Who.
They don't know what to do.
I would never have known about The Bluff community had I not seen it on tv.
If someone at tv land didn't think it was important for us to see,
I would never have seen it.
If the 99% protesters weren't collectively protesting ,
they wouldnt be on tv and the internet.
If they werent on tv and the internet, then who would know
how many people are being negatively affected by corporate greed.

I remember being told that "you cant fight the banks".
WTH?
That always bothered me. I couldn't fathom "above the law".

Look on tv, check out the internet,
don't be afraid to watch what is going on.
If it wasn't important, I guarantee you,
it would not get air time.
And the people in the occupy movement
would be doing something else.
There is a problem and it is a big problem.
The American people are like The Bluff community.
Watching it all fall apart, neighbors losing jobs,
families becoming homeless, crime increasing,
desperation growing.
The 99%ers are the people, the "Who's", in a way.
They may not know what to do,
and individually they really don't count.
But collectively, they will make a difference.

1% can't beat the 99%, that is a mathematical fact.
Its time Americans realized that.
We are the people and we can fix the problem.
Move your money and put into a financial institution
that supports your community. Use the Credit Unions.
Banks are outdated!
You have the right!

Never let the gambler hold the wages. Duh!

It wont be easy, but it is time.

The 99% protesters aren't wrong for protesting against corruption.
If the 99%ers offend you then you are missing the point.
There is a problem that needs addressing.
To ignore the problem anymore would be the demise of your community;
the community we call America.
We can not depend on someone to step in and fix the problem.
We need to band together and begin to collectively acknowledge
and correct the problem so that we can begin to heal.
It is now time to organize.

Oh, woe is First Union aka Wachovia aka Wells Fargo
I started this web site as my only outlet. I look back and see so many similarities between our story and the economy. Stupid greedy banks. Thank goodness they got bailouts to help them work thru their web of lies. But for us and the economy, the bailouts just arent there. The sense of urgency to help them was so strong but they still lie and they continue to foreclose on America. How much pity can we have on the banks? People every where are out of work because of such a greedy banking system. So we bail the banks out and sit back and watch them continue to foreclose. Where did the money go? Poor Wachovia, just cant be trusted with money yet that is who we give our money to for safe keeping. Criminals, that is what Wachovia is in my personal opinion. A bunch of criminals.

Everything Happens For A Reason
No one could have ever told me that there was a reason for the long, drawn out court battle we have experienced with our beloved First Union, aka Wachovia, aka Wells Fargo. I would never have embarked on such a war if Wells Fargo had not sued me. I was left no choice but to fight back.
I want to throw up
when I see the Wells Fargo commercial
about how much they want to be there for their customers.
LIARS! LIARS! LIARS! Blah, blah, blah.
Please dont be fooled by their lies
and I can say this because they lied to me.
No one that works for a living
should be allowed to be taken advantage of by this bank.
Look at your children, what would you do if someone stole their food or clothes or their security?
Invest your money with this bank and you could find out how that feels.
I know it sounds dramatic to the average person but given the chance, this bank would stomp on everything you have worked hard for. Even if they helped you start it.
They would not think twice before leaving you homeless,
they would not think twice before destroying your credit and if you own your own business....well, it isnt pretty.
I do not see any truth in their fancy ads other than their name.
I will prove everything I am saying when I get to go before a jury.
I dont want to settle, I WANT to make it to a jury.
I know for a fact and will prove it that this bank is ruthless and
facilitates on that pathetic characteristic.
This bank lies, lies and lies more to cover those lies.
And why "everything happens for a reason"?
Because the more time goes by, the more proof I uncover.
Wells Fargo, how about spending some of those millions of advertising dollars to correct the mess you made with me? Yes, me.
Since you dont seem to have the business ethics to correct your poor judgement calls, you will clog up an already overwhelmed court system to keep from making it right.
This is a complaint web-site and I have complaints. It is sad that your corporation is so big that my complaints have to be heard by a judge instead of your customer service department, I was an EXCELLENT customer.
And you lied and said I wasn't.
Really? Paper trail...ever heard of such?
If you treat me like you have, what about your current customer?
The one that is struggling to feed their family?
Are they just a liabilty to you now?
God help them because you won't.
Your bank sucks and I will keep up my fight to keep you from hurting another family. And given more time...I may uncover more proof.
I know you hate this web-site, I feel the same about your business ethics. Since no one felt my complaints were worth hearing, I was left no choice.

Court is coming and I am once again going thru the piles of reasons why we would want to pursue a court battle with such a giant.
I always re-read this web-site and I can see where I may seem a little insane.
I always re-read all the information I would find on the internet and there was so little.
I always research new information on the internet to see how many cases like ours there are.
I have come to the decision that the world has changed since 2004.
In 2004
, it was hard to find an attorney that would go up against a bank, everyone said "you cant fight the banks, and win". No one dreamed of posting a collective web-site about how to help people that are being screwed by the banks. The federal government turned a blind eye and a deaf ear to our complaints. Even our friends were hesitant to agree with us.
in 2010,
there are hundreds of attorneys with the ad "bank fraud specialty" or let us help you save your home. the federal government has a new department dedicated to investigating claims like ours. and our friends say "stick with that law suit, someone needs to hold Wachovia accountable".
Times have changed and while I read my rants and raves on this web site, I am tempted to remove some of the comments that were insane sounding. But no! I will not and the reason is;
I am now seeing my same crazy cries for help everywhere. Just do a google on "how to fight the bank" and you will see more support groups for the everyday American that is losing everything because of a bank. I did not have a support group. When I started this site, we had just lost our business completely. We tried to hang on but Wachovia wouldn't have it. I had just lost my sister to cancer. We had no money coming in and had to turn to the Helping in His Name Food Bank. My spirits were broken as well as our checking account. trying to keep a smile for the kids became increasing harder and this web_site became my outlet. I placed my complaints with as many complaint sites as possible but there were no replies from Wachovia or the government or anyone except for other people in my situation. That always did help but now, whoa, now? if you are having a difficult time with our precious Wachovia/Wells Fargo, you have unlimited ways to report and see results from somewhere.
The banking industry should be managed like a convient store. have those cameras on the customers, no doubt but double up the viewing area on the register itself!
the banks steal a hell of a lot more than the occasional bank robber. and bank robbers know the consequences if they are caught, the bank doesn't (or didn't) care.
I guess today's comments are based on the fact that we started off this fight to raise awareness that the banks do lie, steal and cheat. They are not above the law and should be held accountable for how they are running our economy, since they do. Like the bank robber, they should be afraid of the consequences of stealing from us. Come on court, win lose or draw, 12 people will get to see how closely related our case is to the way our economy has fallen. We survived with perseverance and so will the economy, but only because everyone made the banks accountable.

I have received new emails of people getting tired of Wachovia for one reason or another and writing it on their cars.
It is stress relief.
Speaking of stress, look out Wachovia, Mark's ex-wife is coming at you with her own case and I guarantee, you don't want none of her fury. I'm kind of glad to have someone else bypass "Arbitration" and go straight for the "ole judicial system". It could be a close one.

For some reason or another, weird things happen to me....
Let me 'splain.
I have this special "wachovia" box that I keep ALL my 'Wachovia v Chambers v Wachovia' related documents. It holds the original documents to our whole case. While I was thumbing thru the "wachovia" box a few months ago I ran across a letter from Mr. Tom Farr (from 2004). That letter changed the path our lives were on but it also revealed how ruthless Wachovia could be (on paper).
I wanted to read it later but before i could read it later,
my cat used it as her litter box,
and it was bad.
All i could do was cry.
It was destroyed beyond help.
So, i read it one more time and showed it to everyone I knew,
then threw it into the trash, my proof was covered in poop.
I was thumbing thru the same "wachovia" box today and low and behold....there is that same letter. The same one I threw away.
Not a copy, it was the same letter but with no poop!
I know I threw that saturated original letter
into a garbage can. Everyone saw it
and for some reason or another, it made it's way back into that "wachovia" box.
And it doesnt have a single blemish on it.
Go figure...

Why is our case so important? Because we want Wachovia to be held accountable for lies they told and the outcome of their actions. I went to the FINRA website and did a search for Wachovia. WOW! Thousands of complaints, similar to ours but they went to an arbitrator. That means that Wachvoia can settle without admitting guilt. paying fines has become just "cost of doing business" for wachovia but it is devestating to their customers that they prey on. I urge you to check out that website and take the time to read how many times you read "We do not admit nor deny guilt". However, they pay the fines and go on to the next case. I am sure that there is a legitimate reason for the "arbitration" thing but it seems to me that Wachovia has taken advantage of the lack of responsibility it has created for them.

Our hits are starting to come in and the comments are following along. I have a few pictures of cars that were sent to us of unhappy Wachovia customers. The stories that they have leave no question of why they would step out of the box and write on their cars. I will post them as soon as I have technical assistance.

This law suit is a subject that is like the elephant in the room. It is here and we know it is, but the topic has negotiated with our active lives for so long that we try not to re-live the miserable times anymore than we have to. Well, it's time to start dredging up why we are still here. We have found ourselves laughing at some of the actions we have taken in order not to be silenced any more.
My favorite is the green truck, but that was also the most embarassing. You can see the "truck" episode by clicking here. We used our vacation and a friends truck to take our message on the road. Wow! we got heard and seen.
Another effective tool was a simple statement on the back windshield of our car.

Written in shoe polish, it generated more visibility than any one could have ever imagined. No one would listen to us while we begged for intervention, but the general public will stand in a walmart parking lot for hours telling you about their horrible experiences with the same bank.
So, we have decided
to challenge anyone that has been lied to by wachovia, wells fargo or first union to write it on the back of their car. But be ready to explain your words because everyone you come into contact with will want to know why.
Send us your pictures and stories and I will post them on this site. We already have a contact in California that is ready to take the challenge. Lets see where it goes from here.
And again, be ready to talk to everyone you meet, people everywhere really just want to be heard.
Perhaps with enough voices, we can all be heard. We plan to on May 18th! Yipeeeee, court.

Yeah! A court date is upon us!
May 18, 2010, we are scheduled to begin jury proceedings in the Henry County Court House!!! Yeahhhhhh! I believe that Wachovia/First Union/Wells Fargo had no idea that we could endure this battle. I urge anyone that can be at this trial to attend. Why? Because we want everyone to see what a ruthless, lying bank is capable of. Oh yeah, the country is in a recession because of ruthless, lying banks. This trial will be important because we are holding the bank accountable for it's lies and the damages that they caused. But not just on a NATIONAL LEVEL, we are ground zero. Every individual and family that suffered at the hands of a ruthless, lying bank, THIS ONE IS FOR YOU! I don't guarantee that we will win but in 2005, I put it in God's hands and He has led us here. So the outcome is in his hands, too.

I'm tired of waiting! Ever since we trusted Wachovia, First Union, Wells Fargo, (whom ever they are right now), we have had nothing but problems. At first we couldn't see the problems that lay ahead, but that ruthless, lying, unregulated corporation is stopping at nothing to take everything we have. Wachovia, First Union, Wells Fargo is still rubbing salt in the wound by playing a "we will wait you out game". SO LETS GO TO COURT ALREADY! What is the hold up Wachovia? You must have more money than the rest of us. We ARE NOT RICH but we are PATIENT and we have put are complaints in the hands of the United States Court system. YOU need to step up to the plate and lets go to court! It is obvious that First Union/Wachovia/Wells Faro isn't concerned about us anymore now than when our notes were called due. GET ME IN FRONT OF A JURY! Let me tell 12 people how you lied to get our money. I am ready for your defense. YOU LIED TO ME; not once, not twice, not even three times, you lied and lied and lied and lied. Let us get on with our lives. We are adults, we have proven that we aren't going any where, so what is the hold up?

Surely somewhere, in that big bunch of buildings is a human being that can see how long this battle has taken place and will have mercy on us. ALL WE ASK IS FOR OUR DAY IN COURT. Went to Florida to visit family and came home to a copy of a letter to the judge....We are asking the judge to put us on the calendar! YIPPPEEEEE
We need a fight song. I constantly talk to people that say "hey, aren't you the lady that had those signs?" Then they ask what ever happened. I direct them to the web-site and tell them "Not much. But it will soon be a lot." The banks had gotten sooooo out of control with their power and greed that it was common to hear "You can't fight the banks." That is so messed up. Why couldn't you fight the banks? Because they were the ones supplying the BIG monetary backing for many of the offices that were supposed to be watching them. Money to turn a blind eye. A blind eye over OUR money. If everybody used a credit union, where would the banks be? Do they have their own money? No. To take our money and spend it to cover up their mistakes and to fund the baby sitter's to have blind eyes is unbelievable. Even the SEC's response to our complaints was "Wachovia said they didn't do it." What the h#$$? We have so much proof and the SEC was unable to offer any substantial advice because "Wachovia said they didn't do it." How weak!
I guess now that the whole world sees how corrupt the American Banks are, the SEC might want to take a look again at our complaints. Who would have ever thought that the banks would be batching up shaky mortgages with good ones when putting them on the stock market. The very market that determines if your job is safe was destroyed by greedy banks. The very banks that you can't fight in court. And the same banks that were pouring our money into the government agencies; to keep a blind eye. The very agencies that were supposed to be watching our money were protecting the banks, not the people that were investing their money. aaaaaaaaaaaagggggggggghhhhhhhhhhhhhhhh
Wachovia will have to answer to a jury of 12 people and justify their actions. Wachovia is just the first. After our case...PANDORA's BOX IS OPEN! I hope we open up the door for everyone that was affected in a negative way by Wachovia and other big banks. The American People have forgotten that they CAN fight back. I have friends and family fighting over seas so that we as Americans can fight back. Americans fund Wachovia and Wachovia needs to remember that. We alone handed over a million dollars. To me, that is a reason to fight.

Michelle, Look At My Cartoon!
I have found it difficult to update this site every day. My days stay busy just trying to survive, like the rest of you. However, I am being encouraged to keep it up.
Our friends watched us go thru so many stages during of our own little 'Wachovia-induced-recession' but we are still here. We had a thriving business and lost it, we had a beautiful home and lost it. Heck, I dont even own a car any more! But we are still here! That is what one of my friends asked me to write about...how we have survived. It amazes her that we still can find smiles and laughter even after what looks like total devastation. She said we give her hope in her life and maybe we can someone else.
So here it goes....words to live by....
"THEY CANT EAT YOU".
THEY may want to and you may wish THEY could, but THEY cant! You can survive all the financial turmoil in your life if you just remember that God has equipped you with what you need to survive your life. You can cut back and find joy in new things and that can be a good thing. Our family is closer now than ever and money cant buy that.
"CHOOSE YOUR BATTLES WISELY"
After we began to lose what we had trusted Wachovia with, we were in a panic. When my husband worked out of town to make up for the money Wachovia was losing, we fought. When Wachovia decided that THEY would do everything in their power to destroy us, we fell apart. When Wachovia wanted me to file bankruptcy so that they could just write us off....that was the end! We found our inner-strength. I remember crying in the bankruptcy courtroom and my bankruptcy attorney thinking I was a loonatic. Most people would be happy to be able to walk away from such a nightmare. Not us.
It just did not sit well with me that by me declaring bankruptcy, Wachovia would never have to be accountable for the series of actions that put me there. Those actions were Wachovia's and they were UNETHICAL and somebody was going to hear about it one way or another. After going thru the whole bankruptcy procedure, I said 'no'. I decided if I was going to lose everything, then I was going to go down fighting! I had to explain my stubborness to my husband and lawyers. Not everyone agreed but I didnt care. Wachovia filed suit against me for not being able to pay their "DEMAND NOTES". If I filed bankruptcy, I would not be able to counter sue. Hence, that is why Wachovia is being forced to go to court. But back to the reason for this story, we have survived because we let go and let God handle it. Sounds cliche, but it works. In my heart, I knew that filing bankruptcy was an easy way out for Wachovia. I also knew that we would survive, some how, if we just kept the faith. We lost our income, we lost our home and we almost lost our marriage, but we have survived.

Laugh. Just laugh because it is not the situation you are in but how you deal with it that makes you who you are.....so just laugh. A smile will scare your apponet more than you would think!

We are still here, waiting for a date from the judge! We are inviting anyone and everyone to
come to our trial. We may win, we may not. If we make it to a jury trial then we have endured a
lot. Ask anyone you know how hard it is to go face to face with a giant like Wachovia...it ain't
easy.
We hope to be able to make a change somewhere in the banking industry. I personally would like to see deposit banks (the ones that keeps your money safe) and investment banks (the ones that invest your money) separate. The two should not be under one roof because it becomes a conflict of interest. In my opinion, and if history means anything. We went thru the great depression because of similar circumstances. This is my opinion and I encourage anyone to tell me different.
I will try to update this diary as much as possible until the jury makes a decision.

While we watch the falling of the stock market we are reminded by the 'experts' not to freak out and sell. "If you are in your twenties, thirties and even forties, don't sell." We are reminded that the market is for long term investors and the market will bounce back. When i hear that I can't help but cringe because I think of how much money we lost at the hands of unregulated brokers.
We trusted Wachovia with our family's future. Because no one was watching Wachovia, Wachovia wasn't watching their brokers. Our investments were put into the trusting hands of the Wachovia securities department and were squandered away with malicious, premature sales, in a matter of days. We had no control over that, we were notified of the sale after our stocks after they were sold (and not for any profit). No one at Wachovia cared when we complained. The SEC found it difficult to believe that a bank could do wrong. But now the whole world is talking about unregulated banks!
How can so many experts know not to sell in a time like this yet our Wachovia broker was allowed to do it? Our story is from the past 5 years but it reveals the beginning of the damage the non-regulated banks would do and have done.
If you ever hear "YOU CAN'T SUE THEM IN COURT" then you can guarantee that "THEY" are not being regulated enough!
Shame on you, Wachovia! Shame on you for raping everyone that trusted you!
